Franchising
is well established in Germany. It is common in the retail
industry and in certain service industries, such as the dry
cleaning, car-rental and travel businesses. It is most prominent
in the hotel and restaurant industry. Franchising plays an
important role in Germany today and is still growing stronger.
Franchisors as well as franchisees can find a stable economic
environment, enormous buying power, and a large pool of well
trained employees.
There
is no special statute in Germany governing the franchise relationships.
All problems affecting franchising systems can be dealt with
on the basis of existing laws. These include the Commercial
Code, the Civil Code and the European Anti-trust law.
